Eric R. Stern represents employees and executives in all aspects of employment law, including contract / bonus issues, individual discrimination / sexual harassment cases, non-competition / restrictive covenant litigation, executive contracts and compensation, and wage and hour class action. Eric’s clients are predominantly executives, individuals and partners in the financial services, advertising, and media industries.

Eric has extensive experience in Federal and State Court litigation and arbitration before the NASD, NYSE, and AAA, concerning employment and general commercial litigation disputes.

Eric has successfully negotiated many matters both within the employment context including the review and preparation of employment contracts and compensation guarantees, as well as severance agreements and other exit arrangements for executives and other professionals. Eric has had several years of transactional experience, structuring and drafting operating / partnership agreements, shareholder agreements and other partnership and corporate documents, assignments, indemnification agreements, stock purchase agreements and other corporate documents.

On the employer-side, Eric has counseled clients with the development of employment policies, including reviewing and drafting employee contracts, manuals, sexual harassment and drug testing policies, credit reporting policies under the FCRA, confidentiality, non-solicitation and non-competition agreements and electronic document policies. He also has experience providing general labor and employment services and counseling to clients in various industries, specializing in financial services, medicine, staffing and real estate.

Eric has authored numerous articles on employment law topics including discretionary bonuses, insider trading, employment liability issues in the contingent workforce, FMLA notice and overtime laws. Eric also remains on preferred employment counsel lists for various organizations throughout New York City. Eric has also served as a guest lecturer and panelist at several employment-law symposiums.

Eric serves as special counsel to various organizations, including working closely, on a predominantly pro bono basis, with Agudath Israel of America and the Orthodox Union, handling hundreds of work-related cases per year concerning workplace religious freedom, and other policy and cutting-edge legislation involving greater civil rights for all employees.

Eric has appeared in all media venues including, CNN Morning America, Fox-TV, WABC-TV, WNBC-TV, WCBS-TV, NY1, WABC News Talk Radio, The Daily News, The New York Post, and most recently was the subject of a feature article in The New Times.

Eric holds an honors degree in Accounting from Brooklyn College (B.S., cum laude, 1996). He earned his law degree at Brooklyn Law School (J.D., 2000) where he was a member of the Moot Court Honor Society and Trial Division.

Since 2000, Eric has been a member of the New York Bar and is admitted to practice before the District Courts for the Eastern and Southern Districts of New York. He is also a member of the Association of the Bar of the City of New York, the American Bar Association, and the New York Bar Association where he is a member of the Business Law and Labor & Employment Law sections. Eric is also a member of the National Employment Law Association (NELA).
